General terms and conditions of sale

The present conditions of sale are established between Dumortier Stéphane, residing at 9 rue des Rosiers 56320 Le Faouet, sole trader registered under the number 932508955, hereinafter referred to as ‘FANTASTIC MADE’, manager of the website www.fantasticmade.fr, and any individual or legal entity wishing to make a purchase via the website www.fantasticmade.fr, hereinafter referred to as the ‘buyer’.

Article 1. Purpose

These conditions of sale establish the contractual relations between FANTASTIC MADE and the purchaser, as well as the rules applicable to any purchase carried out via the www.fantasticmade.fr site. Buying a product on this site means that the buyer accepts without reservation these conditions of sale, which he acknowledges having consulted before ordering. The purchaser affirms that the purchase of products on www.fantasticmade.fr has no connection with his/her professional activity, being intended exclusively for personal use, and that he/she possesses the legal capacity necessary to adhere to these general conditions of sale. FANTASTIC MADE reserves the right to change these conditions of sale at any time to comply with new regulations or to improve the experience on its site. Consequently, the conditions in force at the time of the buyer's order will be those applicable.

Article 2. Products

The products available are those listed on the site www.fantasticmade.fr, subject to stock availability. Fantastic Made reserves the right to change the range of products at any time. Each product is described on the site by a description detailing its main technical characteristics. The photos are representative but do not engage the responsibility of the Seller. The sale of products on www.fantasticmade.fr is aimed at buyers in countries where the import of these products is authorised.

Article 3. Prices

The prices displayed on the product sheets of our online catalogue are indicated in Euros (€) and include all taxes. Fantastic Made reserves the right to change its prices at any time, but the price displayed in the catalogue at the time of the order will be the one applicable to the buyer. The prices mentioned do not include delivery costs, which are invoiced in addition to the price of the products according to the total amount of the order. If you place an order from outside France, your order may be subject to taxes and customs duties on arrival at its destination. You are responsible for paying these taxes and duties and we advise you to check with the relevant local authorities. You must also ensure that importing the items ordered is authorised in your country.

Article 4. Order and terms of payment

Fantastic Made offers the buyer the possibility of ordering and paying for its products in several stages, with a selection of payment options:

For a secure payment via Paypal or credit card (through PAYPAL or STRIPE), the buyer chooses his products in the ‘basket’, adjusts if necessary (quantities, promotion code), and enters a new delivery address with the choice of country of delivery. The shipping costs are then calculated and presented to the buyer, along with the name of the carrier. The buyer then selects the payment method: ‘Payment by Paypal or bank card via Stripe’. The next step is to review all the information and to read and accept the general terms and conditions of sale by ticking the appropriate box, before confirming the order by clicking on ‘Confirm my order’. The buyer is then redirected to the PAYPAL or STRIPE secure interface where they can enter their account or credit card information in complete security. It is possible for the customer to pay in 4X without charge for amounts from 30 to 2000€. Once payment has been made, the order is validated and the contract is irrevocably established. Confirmation of an order implies acceptance of the present terms and conditions of sale, recognition of their full understanding and abandonment of the customer's own terms and conditions of purchase. The data provided and the recorded confirmation will constitute the proof of the transaction. Fantastic Made will send by email to the buyer the confirmation of the recording of his order. All online banking transactions are secure. Article 5. Property reserve

Fantastic Made keeps the whole property of the sold products until the complete collection of the price, including the principal, the expenses and the taxes.

Article 6. Withdrawal

In accordance with article L121-20 of the Consumer Code, the buyer has a period of fourteen working days after receipt of his order to exercise his right of withdrawal. This right allows the product to be returned to the seller for exchange or reimbursement without penalty. To do this, the buyer must contact Fantastic Made by email at stephanedumortier56@gmail.com. The returned product must be in new condition, in its original packaging, and the return costs are at the buyer's expense. The right of withdrawal does not apply to personalised products or products made to the customer's specifications, as stipulated in article L221-28 of the French Consumer Code.

Article 7. Delivery

Deliveries are made to the address specified on the order form, which must be within the agreed geographical area. Orders are sent by La Poste via COLISSIMO, a tracked delivery service which requires a signature on receipt (except in certain countries). Delivery times are given as an indication; in the event of delay attributable to the carrier or unforeseen circumstances of force majeure, Fantastic Made cannot be held responsible. Fantastic Made will send by e-mail to the buyer the tracking number of his parcel. If the purchaser is absent at the time of delivery, he will receive a calling card allowing him to collect the products ordered at the nearest post office, within the time specified by the postal services. The risks of transport fall to the purchaser as soon as the articles leave the premises of Fantastic Made. It is the responsibility of the buyer to check the condition of the package and its contents in the presence of the deliveryman or the agent of the Post Office. In case of damage during transport, any complaint must be addressed to the carrier within three days of receipt.

Article 8. Guarantee

Each product supplied by Fantastic Made is covered by the legal guarantee in accordance with articles 1641 and following of the Civil Code. If a sold product is not in conformity, it can be turned over to Fantastic Made which will proceed to its replacement, exchange or refunding. Any claim, request for exchange or refund must be made by post to the following address: 9 rue des Rosiers, 56320 LE FAOUET, within thirty days of delivery.

Article 9. Responsibility

Fantastic Made, as part of the distance selling process, is only bound by an obligation of means. The company shall not be held responsible for any damage resulting from the use of the Internet such as loss of data, intrusion, viruses, interruption of service or other involuntary problems.

Article 10. Intellectual property rights

All the contents of the www.fantasticmade.fr site, including photos, logos, visuals and texts, are the exclusive intellectual property of Fantastic Made (E.I., Dumortier Stephane) and may not be reproduced, used or exploited, even partially, without authorisation.

Article 11. Data of a personal nature

Fantastic Made undertakes to protect the confidentiality of information provided by the buyer, necessary for the use of certain services. This information is treated in accordance with the law n° 78-17 of January 6, 1978. Users therefore have the right to access, modify and delete their personal data. They may exercise this right by sending a request by post to the following address: Fantastic Made, 9 rue des Rosiers, 56320 Le Faouët.

Article 12. Settlement of disputes

The conditions of distance selling set out here are governed by French law. In the event of a dispute, the consumer and the seller will endeavour to reach an amicable agreement. If mediation is necessary, Fantastic Made will suggest a consumer mediator. In the absence of an agreement, any dispute or litigation will be submitted to the Court of Lorient, which will have sole jurisdiction.
